KSeF System Failure: How Offline Mode Works

The National e-Invoice System (KSeF) has been designed as a central, 24/7 platform for issuing and receiving structured invoices in Poland. In practice, however, like any IT system, it may be temporarily unavailable. This may be due to planned technical work by the Polish Ministry of Finance, unforeseen outages, or infrastructure issues on the part of the business, such as lack of internet access.


To reduce the risk of sales and billing disruptions, the legislator has provided emergency mechanisms: offline and offline24 modes.Their proper understanding and implementation is crucial to maintaining business continuity.

Working Models at KSeF – When Does It Work Online and When Offline?


The method of issuing and submitting an invoice depends on the current availability of the KSeF system and the technical situation on the entrepreneur’s side.


Online mode: This is the standard operating model. Once issued, the invoice is immediately sent to KSeF and assigned a unique identification number by the system.


Offline mode: This only applies when the Ministry of Finance officially declares the KSeF unavailable – either planned or sudden, such as a KSeF system failure. Invoices are then issued locally and transferred to the system once it is restored.


Offline24 mode: This is available to businesses continuously, regardless of Ministry of Finance announcements. It can be used for purposes such as:

  • lack of internet access,

  • failure of the financial and accounting system,

  • significant delays in the operation of the KSeF.


This solution is particularly important from the operational perspective of companies with a large volume of invoices or operating in a continuous mode.


KSeF Certificates and QR Codes – The Foundation of Offline Invoicing


Issuing invoices outside of KSeF naturally raises questions about their authenticity and verifiability. Invoice issuer certificates, generated directly within the KSeF system, play a key role here.


The certificate allows the accounting system to generate a QR code, which must appear on the invoice visualization sent to the contractor (e.g., in PDF format). This code allows the buyer to verify the invoice, even if the document has not yet been technically registered in the Ministry of Finance's central database.


From a business perspective, the certificate serves to secure sales processes in the event of unavailability of central systems.


Legal Status of an Invoice Issued Offline


An invoice issued outside the KSeF retains full legal validity, provided that certain formal requirements are met:


  • Moment of validity – the invoice is valid from the moment it is issued.

  • Date of issue – must correspond to the actual moment of creation of the document.

  • Obligation to submit to KSeF :

    • up to 1 business day – when using offline24 mode or short-term unavailability,

    • up to 7 business days – in the event of an official failure announced by the Ministry of Finance.

  • Document distribution – VAT payers will ultimately receive the invoice in the KSeF, while consumers or entities without a Tax Identification Number can receive it by e-mail or in paper form.


Marking and Checking Invoices Sent Late


Invoices submitted to the KSeF after the deadline are marked accordingly in the system. This provides the tax administration with clear information that the delay was due to the use of emergency procedures and not a breach of tax obligations.

However, the condition is that the certificate is used correctly and the statutory deadlines are met.


KSeF System Failure: How to Prepare an Organization for Offline Invoicing?


Preparing for emergencies should be a key element of operational risk management. In practice, it's worth addressing several key areas:


  • IT systems – make sure the invoicing software you use supports offline and offline24 modes.

  • KSeF certificates – Certificates should be generated in advance and available in production systems.

  • Internal procedures – clearly define responsibilities for monitoring Ministry of Finance messages and for sending invoices on time.

  • Team training – employees should know how to issue an invoice with a QR code when there is no internet access.


KSeF Offline - Summary


Offline and offline24 modes are not an exception to the rule, but an integral element of the KSeF architecture. Their role is to ensure business continuity in situations where central systems or local IT infrastructure fail.


Companies that take care of certificates, procedures and team readiness early enough can treat any KSeF failures not as a threat, but as a neutral operational event.
